Please read these terms of use carefully before using the immunitycanada.org website (“Website”). By becoming a contact or by using the Website, you acknowledge your agreement and acceptance of these terms. If you do not agree to all of the following terms and conditions, do not use the Website. ImmUnity Canada (the “Organization”) reserves the right, at its sole discretion, to change these terms from time to time, and your accessing the Website will be deemed to be your acceptance of any changes.

Acceptable Use of the Website

The Website is primarily intended for Canadians affected by primary immunodeficiency disease, including patients and caregivers seeking information and support. You may use this Website only for lawful purposes within the stated context of the Organization’s intended and acceptable use of the Website. The Organization is the sole interpreter of the Website’s intended and acceptable use.

Prohibited Uses General Prohibition

You will not use (or plan, encourage or help others to use) the Website for any purpose or in any manner that is prohibited by these Terms of Use or by applicable law.

Specific Prohibited Uses

You agree you will NOT:

  1. Impersonate another person, living or dead;
  2. Post any incomplete, false, or inaccurate biographical information or information which is not about you;
  3. Delete or revise any material posted by any other person or entity;
  4. Disclose to or share your password with any third parties;
  5. Communicate anything that is sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive or hateful, or anything that is embarrassing or offensive to any person or entity;
  6. Make any unauthorized commercial use of the Website;
  7. Post any information that purports to be, or could be viewed as, medical advice; and,
  8. Send unsolicited commercial email to members.

Liability

You acknowledge that:

  1. The information on the Website may be changed or updated from time to time and that certain information may be of a historical nature and should be understood as referring to events and circumstances as they existed on the date that the information was published;
  2. Information posted on the Website is provided for educational purposes only, and no information on the Website should ever be viewed as medical advice or as supplementing or replacing a full diagnosis and treatment discussion with a qualified healthcare provider;
  3. The Organization will attempt to ensure that all information it posts on the Website is accurate at the time the information is added, but there is no guarantee that this information is accurate;
  4. The Organization has no control over the information posted on its Website by Contacts. Any information posted by contacts should be regarded with caution;

Termination

The Organization reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to, deletion of your postings from this Website and immediate termination of your registration with or ability to access the Website and/or any other service provided by you to the Organization, upon any breach by you of these Terms of Use.

Indemnity

You agree to defend, indemnify and hold harmless the Organization, its officers, directors, employees and agents, from and against any claims, actions or demands, including, without limitation, reasonable legal and accounting fees alleging or resulting from your use of the Website or your breach of these Terms of Use.

Jurisdiction

These legal notices are governed by the laws of the Province of Ontario.
